These Terms and Conditions, along with our Privacy Policy and other applicable policies (“Terms”), constitute a legally binding agreement between GAANA DISTRIBUTION (“Company”, “we”, “us”, or “our”) and you (“User”, “Artist”, “you”, or “your”) regarding the use of our website, music distribution services, and related offerings (collectively, the “Services”).

By accessing our website or using our Services, you confirm that you have read, understood, and agreed to these Terms. We reserve the right to modify or update these Terms at any time without prior notice. Continued use of the website or Services after updates constitutes acceptance of the revised Terms.

1. User Information & Account Responsibility

To access and use our Services, you agree to provide accurate, current, and complete information during registration and throughout your use of the Services. You are solely responsible for maintaining the confidentiality of your account and for all activities conducted through your account.

2. Service Eligibility & Artist Requirements

​

GAANA DISTRIBUTION reserves the right to approve or reject any artist, release, or submission at its sole discretion.

To maintain the sustainability and quality of our distribution services, we may prioritize working with artists who meet at least one of the following conditions:

  • Have a minimum of 500 monthly listeners on Spotify; or

  • Achieve at least 1,000 Spotify streams within 6 months of release.

Failure to meet these performance benchmarks may affect continued distribution support for future releases.

 

3. Streaming Performance Policy

 

GAANA DISTRIBUTION regularly reviews distributed content based on platform performance and operational sustainability.

Songs or releases that receive fewer than 1,000 Spotify streams over an extended period and fail to generate sufficient revenue may be removed from streaming platforms at our discretion.

For this evaluation process, only Spotify stream data may be considered unless otherwise stated.

Artists acknowledge and agree that:

  • Distribution does not guarantee permanent availability on streaming platforms.

  • Content availability is subject to platform compliance, operational costs, performance standards, and company policies.

  • GAANA DISTRIBUTION reserves the right to remove inactive or underperforming releases without compensation or liability.

 

4. Payments & Fees

You agree to pay all applicable fees associated with the Services you purchase or use.

Unless specifically mentioned otherwise, all payments made to GAANA DISTRIBUTION are non-refundable after successful delivery or processing of the Service.

5. Refund Policy

​

You may request a refund only if we are unable to provide the purchased Service. Refund requests must be submitted within the timeline mentioned for the specific Service or policy. Failure to request a refund within the allowed period may result in ineligibility for a refund.

6. No Guarantees

​

Neither we nor any third party provides any warranty or guarantee regarding:

  • Streaming performance,

  • Revenue generation,

  • Playlist placements,

  • Audience growth,

  • Platform approval,

  • Continuous availability of content, or

  • Accuracy and completeness of information provided on the website.

All Services are provided on an “as is” and “as available” basis.

7. Intellectual Property

All content, branding, logos, website design, graphics, software, and materials available on the website are the intellectual property of GAANA DISTRIBUTION unless otherwise stated.

You may not reproduce, copy, distribute, or exploit any part of the website or Services without written permission.

 

8. User Conduct

 

You agree not to use the website or Services for any unlawful, fraudulent, misleading, infringing, or prohibited activities, including but not limited to:

  • Copyright infringement,

  • Artificial stream manipulation,

  • Uploading unauthorized content,

  • Fraudulent royalty practices,

  • Fake metadata or impersonation.

Violation of these Terms may result in account suspension, content removal, withholding of royalties, or legal action.

 

9. Third-Party Platforms

 

Our Services may distribute content to third-party platforms including Spotify, Apple Music, YouTube Music, Instagram, and others.

You acknowledge that all such platforms operate under their own rules, policies, and algorithms. GAANA DISTRIBUTION is not responsible for decisions made by third-party platforms, including content takedowns, monetization restrictions, account penalties, or stream removals.

 

10. Limitation of Liability

 

Your use of the website and Services is entirely at your own risk. GAANA DISTRIBUTION shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Services.

 

11. Force Majeure

 

We shall not be held responsible for any delay or failure in performance caused by events beyond our reasonable control, including natural disasters, technical failures, government actions, internet outages, platform policy changes, or other force majeure events.

 

12. Governing Law & Jurisdiction

 

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising out of or relating to these Terms shall fall under the exclusive jurisdiction of the competent courts of India.
